The No Name Pins Ita Bag Giveaway (the "Contest") is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years old at the time of entry. For purposes of eligibility to participate in this Contest, a person shall not be considered a legal resident of one of these locations unless that person is actually living in such state at the time of entry and at the time any prize is awarded. The Contest is void where prohibited. Winners shall be required to sign an affidavit of eligibility and liability/publicity release ("Affidavit and Release") as a condition to the delivery of the winning prize, except where prohibited. Via Mail: Sponsor is not responsible for any lost, damaged, illegible, or undelivered entries. Entries submitted via the mail-in entry method are subject to all terms and conditions of the Contest except for authorization for promotional contact. Entrants using the mail-in method will only be contacted in the event that they are the Contest Winner, they have submitted an online entry, or they have requested a Winner List.
All entries must be received by 11:59:00 PM EDT July 20, 2023 to be considered any prize or additional awards for Contest entries.
Limit of one (1) Entry per eligible person, per day during the Contest Period. For purposes of this Contest, a "day" begins at 12:00 a.m. ET and ends at 11:59 p.m. ET unless specified otherwise. If multiple Entries are received during the same day, only the first Entry will be accepted and additional Entries will be disqualified. Multiple participants are not permitted to share the same email address. Any attempt by you to obtain more than one (1) Entry per day by using multiple/different email addresses, identities, registrations or logins, or any other methods may void your Entries and you may be disqualified from the Contest. Any use of robotic, repetitive, automatic, programmed, or similar entry methods or agents (including, but not limited to, sweepstakes entry services) will void all Entries by you. In the event of a dispute as to any online Entry, the Authorized Account Holder of the email address used to enter will be deemed to be the entrant. The “Authorized Account Holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Prospective Grand Prize Winner may be required to show proof of being the Authorized Account Holder.
The only exceptions to this limitation of number of daily entries will be for additional bonus entries awarded by Sponsor for participation in any programs or activities officially offered and sanctioned by Sponsor during the course of the Contest. All entries become the property of Sponsor and will not be acknowledged or returned.
On or about July 20, 2023, the Sponsor will select (1) Grand Prize winner of the Contest. Winner will be selected in a random drawing of all eligible entries received by the deadline. All decisions made by the Sponsor are final. Additional awards may be issued, at the sole discretion of the Sponsor, to some or all entrants who have properly completed and submitted a contest entry by the appropriate entry date.
Selected winners will be notified by email, mail, text message or telephone. Each potential winner will be required to complete, electronically sign, and submit a Declaration of Compliance within seven (7) days of the date of notice or attempted notice is sent, in order to claim his prize. Winners shall be required to sign an affidavit of eligibility and liability/publicity release ("Affidavit and Release") as a condition to the delivery of the winning prize, except where prohibited, and will be required to confirm a physical mailing address (no PO Box or virtual addresses) located in the fifty (50) United States and the District of Columbia to receive delivery of the Prize. Failure of any winner to respond or return any required Affidavit and Release (properly completed and executed) within the specified time may result in forfeiture of the prize and selection of an alternate winner from the remaining eligible entries. Except to the extent prohibited by law, each entrant authorizes the Contest Entities to use his/her name, voice, likeness, biographical data, city and state of residence and entry materials in programming or promotional material, worldwide in perpetuity, and on a winner's list, if applicable, without further compensation. The Contest Entities are not obligated to use any of the above-mentioned information or materials but may do so and may edit such information or materials, at the sole discretion of the Contest Entities, without further obligation or compensation. If the potential winner cannot be contacted or fails to submit the Declaration of Compliance within the required time period, or prize is returned as undeliverable, potential winner forfeits prize. Entries and prizes are nontransferable. No prize may be exchanged for cash. No transfer, assignment, or substitution of any prize by any winner is permitted. Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value. Prizes may only be delivered to physical addresses located in the fifty (50) United States and the District of Columbia.
One (1) Grand Prize will be awarded, consisting of one (1) Fully accessorized ita bag complete with pins, buttons, plushie, and keychain. Retail value of $150 USD. Accessories chosen at the Sponsor's discretion will be provided with the bag as part and parcel of Grand Prize.
Ten (10) Second Place Prizes will be awarded, each consisting of a set of three (3) enamel pins. Each Second Place Prize winner will receive their choice from at least five (5) such sets selected and offered by the Sponsor at the time of award.
Sponsor may conduct surveys via Facebook or other means to allow followers of the No Name Pins Facebook page to vote on their preference of specific accessories or pin sets to be awarded. Any such vote or survey results will not be binding on Sponsor; Sponsor reserves the final decision on all such prize inclusions. All selections will be considered to have the same retail value and to have no effect on the estimated retail value of any prize.
All entrants who complete and submit Contest entries by the Contest deadline may be eligible, at the sole discretion of the Sponsor and/or its affiliates to receive additional promotional offers. These awards are not prizes and will not be included in the Winner List. Recipients may be notified by SMS text-messaging, email, telephone or other method, depending on the terms agreed upon. Entry awards are not redeemable for cash and have no cash value. They represent a promotional rate for or discount on goods or services that may be offered by No Name Pins or third parties. Entrants have no obligation to accept these awards and acceptance or refusal will have no bearing on the entrant's eligibility for or chance of winning the Grand Prize or a Second Place Prize.
Prize winners are responsible for any and all federal, state and/or local income, sales, excise or other taxes that may apply, and no Contest Entity shall be liable for any such expense.
In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, work, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. Sponsor reserves the right to disqualify, in its sole discretion, any Entries that appear to be generated by a macro, script or other automated means. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or other operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney's fees) and any other remedies from any such person to the fullest extent permitted by law. By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the "Released Parties") from and against any claim or cause of action arising out of the participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility of miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human printing or typographical errors; (d) lost, late, incomplete, garbled, illegible, undelivered, stolen, damaged, delayed, postage-due or misdirected mail, entries, application downloads, any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants' participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). This Contest is governed by the laws of the United States and the State of Wyoming, without respect to conflict of law doctrines. As a condition of participating in this Contest, each entrant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or in connection with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a state or federal court located in the County of Sheridan in the State of Wyoming. By entering the Contest, each entrant irrevocably consents to personal jurisdiction by the federal and state courts located in the County of Sheridan in the State of Wyoming, and waive any jurisdictional, venue, or inconvenient forum objections to such courts. Further, in any such dispute, to the extent permitted by applicable law, each entrant, winner and guest hereby waives all damages other than such person's actual out-of-pocket expenses (e.g., costs associated with entering the Contest) including, without limitation, all punitive, incidental or consequential damages, attorneys' fees, and fee multiplication awards. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants' rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by and construed in accordance with the laws of the County of Sheridan and the State of Wyoming without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the County of Sheridan and the State of Wyoming. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the foregoing limitation or exclusion may not apply to every entrant.
